A mechanic's lien refresher for South Carolina subcontractors

During the housing collapse, many construction projects fell through as available financing dried up. This left many project owners without the funds to pay contractors, who in turn could not pay their subcontractors for initial site work that had already been performed. Frequently, construction litigation was required to obtain payment.

As the availability of existing houses remains low, more builders are again starting projects. While it appears that the economy has turned a corner and more buyers are again entering the real estate market, sometimes an owner or contractor will still fail to pay subcontractors for work provided.

Mechanic's liens are powerful tools for contractors and subcontractors. These liens ensure payment for all work performed, but come with strict filing deadlines.

Labor and costs covered

In South Carolina, a person can seek a mechanic's lien when the work performed related to building, improving or repairing a structure on a piece of property. This includes all the work required to prepare a building site, such as boring a well or grading a construction site.

Some other work covered by the South Carolina mechanic's lien statute includes:
- Preparing plans and design drawings;
- Excavating and bulldozing work;
- Paving roads is a potential development, as well as putting in sidewalks and constructing ditches and drainage; and
- Laying pipe and putting in conduits for electric, gas and water.

The subcontractor must prove that the owner or an agent (a general contractor, for example) consented to the work. An oral agreement with a contractor - even though never placed in writing - to install a new furnace would still satisfy the above requirements.

A person who files a lien can also collect the costs needed to bring the action and reasonable attorney fees when the prevailing party. In addition, Lien rights flow from the nature of the work and completion of the structure is not necessary.

Important deadlines

After finishing work on a project, the contractor or subcontractor has 90 days to serve the owner and file the lien in the county where the property is located. The lien must include an accounting of what is owed and a description of the property. Within six months after completion of the work, the subcontractor will need to bring a lawsuit.

If waiting on a payment from an owner or general contractor, contact a construction law attorney to discuss the situation and the filing deadlines for a mechanic's lien. Failure to follow the deadlines may mean that the remedy is no longer available.

New Author Pens Mystery, Not Fairy Tale: Rachel Gripp Releases Pursuit of the Frog Prince, an Investigative Tale of Kidnapping and Murder in the Sleepy Town of Amherst, New York

When Peggy Roberts is kidnapped from her home after a dinner party, Ben Burrows, the detective assigned to the case, suspects foul play when lies, loathing and broken friendships surface during his investigation. While he tries to separate fact from fiction during his inquiries, Megan, the woman's volatile and profanity-driven sister, builds a rapport with the bug-eyed detective and christens him her Frog Prince. Meanwhile, on the other side of town, a principled Seth Stone is unwittingly drawn into the kidnapping web and witnesses a murder before fleeing with the abducted woman. Together they search for answers and ultimately join forces with the detective in an attempt to solve the case.

In this mystery, everyone questioned has an opinion and voices it loudly. This, of course, drives Ben Burrows crazy, but it adds a lot of humor to the ongoing investigation. Gabriel also has strong opinions, but no one pays much attention to the German Shepherd.

Expert Witness Stephen Delgado recently rolled out his Mold Awareness and Prevention Seminar, which draws on Stephen's more than 25 years of experience in the water damage restoration and indoor air quality industries. Stephen has seen first hand the perils of ignored excess moisture on building materials. He has performed insurance restorations, flood damage restorations, emergency services, structural drying, and mold-related services on millions of square feet in commercial and medical properties since he began his career in construction. Road Construction Company's "Green" Road Project Wins Prestigious Award


The American Road and Transportation Builders Association (ARTBA) recently awarded the prestigious 2013 Globe Award to Reeves Construction Company (Reeves), a leading road construction and maintenance company, for its project on Highway 247, Bibb and Houston County, Georgia. The project, a collaboration among Reeves Construction Company's West Division, the Georgia Department of Transportation (GDOT) and an Illinois firm named Rubber Asphalt Solutions (RAS), the leader in Rubber Modified Asphalt production, was months ahead of schedule, set the new green standard in asphalt paving and made Reeves the leading construction company in the practice of developing green infrastructure.

The project called for milling and paving all the lanes of the 5.179 miles of roadway from Echeconnee Creek all the way to Liberty Church Road in Georgia's Bibb and Houston Counties. All of the 27,250 tons of asphalt used was mixed with ground tire rubber, a big, bold step for Reeves toward minimizing the project's carbon footprint and establishing itself as a leader in environmentally sensitive infrastructure development.

Reeves was the first road construction company to perfect the plant induced method of modifying with ground tire rubber. Prior to this, all modified binders were terminally blended and shipped to the production plant. The benefits of this system is the ability to modify binders at the flip of a switch or on demand. Past issues related to binder storage and low quantity projects are no longer an obstacle to be dealt with. Other benefits of using RMA include serviceability comparable to polymer modified mixture, reduced road noise, reduced cracking susceptibility, the addition of stability to the fragile and dynamic binder modifier market, and that it makes use of discarded tires that would otherwise be merely thrown into landfills; adding to growing environmental concerns. Approximately 20,000 end-of-life tires were used in the project.

The Highway 247 project sought to improve transportation quality while achieving reduced carbon footprint. Reeves attributes the success of the endeavor to seamless collaboration with industry partners who were committed to the same goals. These collaborators include the GDOT, led by Charles Hasty, State Materials Engineer, and its Bituminous Construction Branch, which had pushed for the using recycled rubber instead of conventional binder modification materials. Georgia State Representative Randy Nix and the Office of Materials saw to the necessary changes in the Standard Specifications that allowed crumb rubber modification to be used in all asphalt mixtures. Rubber Asphalt Solutions (RAS) of Taylorville, Illinois developed the technology for plant induced modification method, while the processed tire rubber that allowed for the binder to attain the required performance grade was supplied by LeHigh Technologies.

Wayne Marshall, Corporate Quality Control Manager for Reeves, was also honored this year by the Georgia General Assembly for his single-minded dedication and perseverance resulting in the success of this project. "The material is placed with standard paving equipment and is easy to handle," said Marshall. "The additive trans-polyoctenamer (TOR) helps workability and reduces fume. The advantage of the plant mix is that we can make a high-quality modified asphalt on site, on-demand, reducing costs to the contractor and ultimately to the owner agency."

Best Property Values in a Decade in San Miguel de Allende, Mexico InternationalLiving.com

InternationalLiving.com has uncovered a range of properties in sought-after San Miguel de Allendewith price tags starting at $130,000.

San Miguel de Allende is one of Mexicos best-known Spanish-colonial towns and has been a top expat haven for decades. Its cobbled streets are lined with gaily-painted houses and the town attracts artists, writers, and musicians from around the world.

Although San Miguel has been popular with expats for the past 50 years, real estate is at bargain prices right nowdown as much as 55% from highs in 2007/2008.

But youd better move fast, warns InternationalLiving.com Mexico editor, Glynna Prentice.

In the euphoric early 2000s, prices in San Miguel rose dizzyingly. Real estate firms saw prices nearly double up to 2007. Then, with the recession, the market dried up. Buyers just didnt have the liquidity, explains Prentice.

But in the last yearand especially in the last six to eight monthsthe trend has been reversing. Buyers from Canada, Europe, the U.S., and elsewhere are back and properties are selling at all price points. There is plenty of selection in the $200,000 to $300,000 range. But even properties in the $800,000 to million-dollar-plus range are moving.

Centro is where 70% of expat buyers choose to bewithin easy walking distance of all the action. Properties here have generally held their value slightly better than those in outlying neighborhoods.

Yet Centro doesnt have to be expensive, says Prentice. Listed right now, for instance, is a fully-furnished, one-bedroom/one-bath apartment, with nearly 1,000 square feet of space, for just $189,000. A slightly larger fixer-upper, with three bedrooms and two bathrooms, is on sale for $130,000.

Youll find two- to three-bedroom homesin Centro, though maybe a few minutes farther from El Jardin (ground zero for San Miguels action)starting in the mid-$200,000s.

Outside of Centro, there are plenty of properties available in neighborhoods like San Antonio and Guadalupeabout a 10-minute walk away. Here, you could buy a two-story house in San Antonio, for example, for $199,000.

And you can still find fixer-uppers or basic properties in these neighborhoods starting in the low $100,000s.

The complexities of red tags and zoning codes in Santa Cruz

If you own property in Santa Cruz County or are intending to purchase property, it may be a good idea for you to become familiar with red tag violations and zoning codes. There are several rules and ordinances in place in how a property can be used and what can be built or placed on the property. Without the proper permits and zoning adherence, you could find yourself in a legal mess.

In February 2012, the owners of an Italian eatery found themselves the target of a red tag violation that put a stop to the renovations they were performing on a new location for their restaurant, according to the Santa Cruz Sentinel. The violation was related to major renovations that took place at the restaurant without the necessary permits. As a result the city issued a stop work order until the necessary work permits were acquired.

Red tags

If officials inspect a property in Santa Cruz County and find that there have been unauthorized changes made to that property, then they issue what is referred to as a red tag. Examples of red tag violations include:
- Turning a garage into a bedroom
- Adding on an additional floor without permits
- Improper wiring
- Septic systems in the wrong place
- Mold
- Building new structures without permit

Once a building or property is hit with a red tag, the process to remove that red tag can be extremely complicated. For example, if a septic system was installed incorrectly, the owner may be required to dig it up, remove it, make appropriate repairs to the land composition, and then re-install it.

In addition, you may also have to pay county fees and penalties as well as appear in court to resolve the issues associated with the property.

Zoning Code

Essentially there are two types of property zoning--residential and commercial. Property can be assigned one zone, such as residential, and then be changed to a commercial zone in Santa Cruz with the approval of the city's Planning Commission. It is important to make sure that before you build anything on the property, you understand what your land is zoned for.

Within each zoning code are additional codes that determine the type of building, the size of the building, the number of animals the land can hold, the height of the building, and additional details relating to what can be built on the property. For instance, if you own residential property and you want to build a town house or a small apartment building on it, then you likely need to apply to the city or county in order to be approved for that project.

The same is true for a commercial zone. There are specific guidelines in place that designate what type of building and business can be operated on that site. Any violation could result in enormous fines and penalties and costly delays. Therefore, it is a wise idea to consult with a legal professional experienced in real estate law to avoid any complications related to zoning law.

Arizona bankruptcy filings continue near six-month peak

Arizona bankruptcy filings continue near six-month peak

As the economy continues its lackluster performance, wages are not keeping up with inflation. The unemployment rate in Arizona is no longer at 10 percent, but has hovered near the 8 percent mark for more than a year.

Arizona bankruptcy filings hit a six-month high in April and the number has held steady into the month of May. According to the U.S. Bankruptcy Court in Phoenix, 2,234 new cases were filed statewide in April. The number decreased slightly in May to 2,197, but was still well above the roughly 1,400 new cases filed each month at the beginning of the year.

Bankruptcy filings are often seasonal and often increase during tax season. Looking at year-to-year averages the number of filings is still down from this time last year by about 17 percent.

For those who are struggling to make ends meet, a Chapter 7 or a Chapter 13 bankruptcy includes the protection of the automatic stay. This is a window when creditors must stop collection activities and an individual has time to determine the amount that can be paid on his or her debts and which assets can be kept.

Increased property exemptions

Filing for Arizona Chapter 7 bankruptcy protection does not mean that an individual losses all of his or her property. Each state generally has its own criteria on what an individual can keep in a bankruptcy - this property is referred to as exempt property.

Recent changes increased exemption amounts. For example, an individual can now keep household goods, including an ipad or other electronic device up to a total value of $6,000. This was an increase from the previous amount of $4,000. Some other changes included:
-A pet, such as a cat or dog up to the value of $800
-A wedding or engagement ring valued up to $2,000
-A computer valued at up to $1,000
-Equity in a vehicle up to $6,000

In addition to the above exemptions, an individual or a married couple residing in Arizona may claim a homestead exemption of $150,000 for a dwelling, such as a single family home, a condominium or a mobile home.

Chapter 7 versus Chapter 13

In a Chapter 7 bankruptcy, the sale proceeds of non-exempt property are distributed among creditors. A discharge of all the remaining debts means that an individual gets a fresh start. But keep in mind that several types of debts often remain after a Chapter 7, such as child support obligations, some federal tax debts and student loans.

Chapter 13 on the other hand involves a three to five year payment plan, but is a way to avoid foreclosure. An individual needs to have a regular income to make monthly payments, but upon plan completion, any remaining debts are discharged.

A job loss and the long struggle to locate a new job often lead to financial difficulties. Medical bills during an extended illness may reach the point you may never be able to pay them back. One way to stop creditor harassment is by utilizing the protections afforded by a bankruptcy filing. Brazilian Home Buyers to Benefit from Banks Streamlined Lending


Brazilian mortgage lenders will be able to get home buyers moved in faster than ever thanks to a new workflow system being launched today by U.S. mortgage technology company FNC, Inc.

Last fall, Sao Paulo-based CetipLatin Americas largest depository of fixed income securitiesselected FNC to deliver a comprehensive collateral management solution for the Brazilian mortgage industry.

FNC, whose clients are the nations major mortgage lenders and servicers, designed a Collateral Management System (CMS) that continues to revolutionize the $14 trillion U.S. mortgage market the largest industry on earth. Now, FNC is applying its time-tested, 13-year knowledge base to the Brazilian infrastructure.

CMS will streamline the mortgage process to reduce the lengthy time that it takes to process loan applications, said Buster Hale, managing director of FNCs Brazilian office. Were looking at this project as a pilot program. This is a system we can easily replicate in other emerging economies around the world.

FNCs CMS will help to provide increased transparency in the loan process, which will prevent fraudulent appraisals and abuses of the FGTS fundthe primary government fund available to finance home purchases.

With this increased transparency, foreign investors will be more likely to invest in Brazilian mortgage-backed securities as the secondary mortgage market in Brazil grows over the next few years, said FNC CEO Bill Rayburn.

Additionally, Rayburn said the CMS in Brazil will be the conduit for building a national collateral database. In the U.S., FNC built the nations most comprehensive database of residential property information by blending appraisal data with public record and MSA data. FNC clients can tap into the database to gain extensive knowledge about the properties that support their loans.

With a similar national collateral database in place in Brazil, desktop appraisals can be done, which will reduce the cost of appraisals to the banks and also to consumers, said Robert Dorsey, FNC chief of data and analytics. In addition, analytics will be available to predict trends in the Brazilian real estate market, which are not available today.

Roberto Dagnoni, executive director of Cetip, is looking forward to the results of the FNC product launch.
